The Basics

What is a class action?

In situations where thousands or even millions of consumers are cheated out of relatively small sums of money, a class action may be the best way to proceed. Litigation can be expensive, so the cost of filing an individual lawsuit has to be weighed against the amount you might be able to recover. If numerous other consumers have suffered the same or similar damages as you, then a class action might be the best option.

Filing a class action can help consumers maximize their recovery by allowing litigation expenses to be shared. This helps reduce the total litigation costs paid by each class member. Additionally, the large number of people affected can make it difficult or impossible to file that many individual consumer protection cases. A class action helps streamline the litigation and ensure that the case moves forward as efficiently as possible and that all class member damages are addressed and treated equally.

Before a class action can proceed in the courts, at least one wronged consumer has to agree to serve as a class representative. This person will represent the entire class and will work with the attorneys to file the lawsuit and hold the offending company accountable for damages. Once the class action lawsuit is filed, the judge must agree to allow the case to proceed as a class action and appoint the law firm and attorneys who will serve as lead counsel for the case.
