Judge Allows Patients’ Negligence Suits Against Raleigh Radiology To Move Forward

January 7, 2020 (Raleigh, NC) – Today in Branch v. Raleigh Radiology, LLC d/b/a Raleigh Radiology Blue Ridge, Superior Court Judge Vince Rozier, Jr. denied Raleigh Radiology’s motion to dismiss the Plaintiffs’ negligence claims. The ten Plaintiffs are Raleigh Radiology patients who allege that Raleigh Radiology was negligent for failing to maintain the required accreditation and certification required to offer mammography services at its facility located on Blue Ridge Road in Raleigh. After a review performed by the American College of Radiology revealed serious image quality deficiencies, the FDA declared the mammography performed at the Blue Ridge facility to be a serious risk to human health. In December 2019, Plaintiffs, who include breast cancer survivors and women at a higher risk for breast cancer, received letters from Raleigh Radiology notifying them that mammograms performed at the Blue Ridge facility between November 7, 2017 and November 6, 2019 should be reviewed or repeated. Plaintiffs were not told why certain mammogram images were unacceptable; whether their mammogram images were reviewed; or whether their mammogram images were acceptable. The Plaintiffs filed suit against Raleigh Radiology for the emotional distress, anxiety, and mental anguish they suffered as a result of Raleigh Radiology’s negligence.
