Paynter Law Files Class Action Lawsuit against Raleigh Radiology

If you have been keeping up on local news, you are probably aware of the recent FDA-mandated shutdown of mammography services at Raleigh Radiology’s Blue Ridge Road location. This location’s mammography services were suspended after the FDA found that some of their mammogram images did not meet federal standards.

On Dec. 31, Paynter Law filed a class action lawsuit against Raleigh Radiology Blue Ridge on behalf of patients who received mammograms there between November 2017 and November 2019. If you received a mammogram at the Blue Ridge Road location during this time period, you may benefit from joining the lawsuit. Below, we’ll give you more details about the case and tell you what to do if you were impacted.

In December, mammography patients at the Blue Ridge Road location received letters from Raleigh Radiology.
Patients received a letter via regular U.S. mail and one via certified mail. The letters advised patients to “talk with
[their] health care provider as soon as possible about the mammograms(s)” as patients “may need [their]
mammogram(s) reviewed, and possibly repeated, along with possible further evaluation.” from joining the lawsuit.

Raleigh Radiology Loses FDA Accreditation

Paynter Law filed the class action suit to represent patients who may have received substandard mammograms between November 7, 2017 and November 6, 2019. Issues with some mammogram images came to light during reviews by the American College of Radiology (ACR) when it was discovered that some mammogram images taken by Raleigh Radiology at their Blue Ridge Road facility did not meet FDA standards. The FDA promptly suspended mammography services at the Blue Ridge Road location. They also ordered the facility to complete a Corrective Action plan, notify their patients, and work to have their mammography accreditation reinstated.

Paynter Lawsuit Seeks Compensation for Patients

Paynter Law filed the class action lawsuit because Raleigh Radiology did not offer refunds to patients who had paid for substandard mammograms, nor did they offer to cover the expenses of additional scans and results. Through the lawsuit, Paynter Law seeks to help patients be re-paid for the original screenings, as well as reimbursed for costs related to repeating and reviewing the new mammograms done at a certified facility. The class action lawsuit is intended to cover “All patients who had a mammogram performed at Raleigh Radiology – Blue Ridge, located at 3200 Blue Ridge Road, Raleigh, North Carolina, between November 7, 2017 and November 6, 2019.” In addition, Paynter Law is filing individual lawsuits for anyone who
received a mammogram at the Raleigh Radiology Blue Ridge facility between November 7, 2017 and November 6, 2019 and suffered damages such as emotional distress or a missed cancer diagnosis.

The total number of patients potentially impacted by the substandard mammography services provided by Raleigh Radiology Blue Ridge has not yet been revealed, but we believe there may be anywhere between hundreds and thousands affected.
